Here we go toward the end of the Legislative part of "Blago the Clown's" adventure ... tomorrow, more than likely the Illinois will convict him on Impeachment charges, so then this drama will continue with Blago, and U.S. Attorney Fitzgerald ... and the soap continues ...

Glad to see that the "New New Deal" is working out so well with a different kind of politics!

Thumbs down

What I learned from Dem's lack of ethics/morals is**: IF I am ever on trial I am going to remember the Obama / Geithner Defense.

1) I had my lawyers do the investigation and I am not Guilty.
2) I simply made a mistake; ignorance of the law is a valid excuse.

** Depend upon what the definition of is is.

Blagojevich is claiming that he has done nothing wrong, or which would be consistent with criminal activities. This is rather funny as he is the governor of a state and has the power to pardon criminals, yet he himself is proclaiming that he did not commit any criminal act, but one which is most seriously and obviously a criminal act.
Let's run his claim through a basic analysis of criminal law as per the Justice system. We'll set this out in a bulleted list.
      1. The issue which must be addressed is simply: “Whether attempted solicitation of an elected governmental position (BRIBERY) violates the laws of the state of Illinois”--while the answer to this question might seem extremely simple to address, but it must be addressed in order for a criminal proceeding to continue. Indeed Illinois has a statute that makes the very activity the governor engaged himself in.
“A person commits bribery when: ...[h]e solicits, receives, retains, or agrees to accept any property or personal advantage pursuant to an understanding that he shall improperly influence or attempt to influence the performance of any act related to the employment or function of any public officer, public employee, juror or witness.” (Illinois Procurement Code, applicability of this Act, see 30 ILCS 500/50-70. )

Now that we have established that Illinois does indeed have a law prohibiting bribery we need to apply it to the activities of Mr. Blagagovich. Ok that in itself is easy enough. Included in the evidence which has been presented against him are several FBI surveillance recordings that have the governor in his own voice talking about the monetary benefit which he is seeking in exchange for the senate seat the belonged to Lord Barry Hussein Obama. Even with such shocking evidence stacked against him Mr. Blogagovich refuses to acknowledge that he broke the law.
I can't fathom a court of law, if it analyses the issue properly, holding in favor of the disgraced governor of Illinois. Here's what the analysis might look like going in front of a court (or in this case the senate) Under the Illinois anti bribery statute (Illinois Procurement Code, applicability of this Act, see 30 ILCS 500/50-70. ), specifically in sub section (e) of the statute the requirements for violating said statute are clearly listed. It must be determined from the record that the governor
      1. Solicits, receives, retains, or agrees to accept any property or personal advantage.
      2. That such solicitation..etc..are pursuant to an understanding that he shall improperly influence, or attempt to influence the performance of any act related to the employment or function of any public officer, public employee, juror or witness.
Now then the surveillance recordings clearly demonstrate that he had Mens Rea (mental intent if you will) in that he intended to sell the position for a monetary benefit for himself. Certainly such a monetary benefit would violate the statute as he is not only attempting to solicit the position for personal benefit, but he is also attempting to influence the performance of an act related to the employment and function of a public employee.
This sort of happening is quite common in the sphere of politics these days. One doesn't have to look too far back to remember a man who liked to store 90,000 dollars worth of bribe money in his freezer. It seems that very little attention has been given to such men as these, (that's right William Jefferson..your freezer isn't clean).
Of course our media continues to fail the American people by either portraying these criminals in a good light, or in no light at all. Funny how that works isn't it? If anything it just proves that truth we've all known about for quite some time now. Simply put hypocrisy, moral decay, and corruption of our government in the worst degree. If he is not found guilty as charged it would seem then that either the prosecuting attorney is incompetent or else a true travesty or justice will have been laid at the feet of the people of Illinois.

All, I can say is that for once in at least one state, and that is the state of "Illinois" ... true bitarsinship was displayed to out "Blago" ... now maybe they can get to work on helping their Citizens .... glad I don't have this drama going on in my own state (btw, not to brag, but my state, under Conservative leadership, still has one of the lowest unemployment rates in the country) ... now to the last Chapter of the "Blago Drama" , and that is awaiting U.S. Attorney Patrick Fitgerald's Indightment!

I know this post will bring many differing oppinions on this whole scenario, but the "kangaroo court" in the Illinois Senate goes on ....

I don't like Blago, but I do agree that he has been given less rights than Gitmo Detainees ... and why does Fitzgerald hold on so long to indighting him?

He has to know something more, and isn't revealing it .... maybe it relates to the current power that is residing at the Whitehouse ... maybe I could be wrong ... but it's interesting to see where this case will end up!!!!

Let me know what you think?

While I am in total lockstep with you, I would not be so quick to push Obama's name aside on this thread, for this reason.

Yesterday while Blago addressed the legislators he said a few things that really ring loud, things like if you go after me, you'd better go after Raum Emanuel because this whole thing was his idea. If you go after me, you'd better go after other governors, pointing out Wisc. and others.

My point is this. If he is already throwing others under the bus what is he going to do when it really gets hot, when feds offer him a deal for a lighter sentence, like a possible plea bargain to turn states evidence on possible co-conspirators. Like I said this thing is just getting started and it has yet to get uglier,, more to come.

Do we foresee:

-- US AG Eric Holder deciding to skip Federal Prosecution of Blago?
-- A Mr. Obama Pardon in the Works for Blago to keep his lips shut?
-- Blago found sitting on a park bench?

As PB says it is going to get interesting.
